Do I have a right to recover?

Under Pennsylvania law you must prove that one or more of the defendants is at least 50 percent at fault. You also need to establish that the defendant's negligence caused your injuries. The specific requirements and issues vary depending on what type of accident you have. (Visit the other portions of this site for a more detailed discussion.) The defendant will oftentimes claim that the accident was partially the victim's fault or the injuries are not related to the accident. What compensation can I expect?

Cases vary from one to the next and multiple issues must be taken into consideration. Pennsylvania state law allows compensation for past and future medical bills, lost wages, lost earning capacity, disfigurement, and other pain and suffering. In some claims such as car accidents, if the medical bills have already been paid you cannot submit them for recovery. There can also be a separate recovery for your spouse called loss of consortium. Having settled thousands of cases we know how to evaluate all of your claims to make sure you are fully compensated.

When will my case be resolved?

Each case varies in how long it takes to resolve. Settled claims are just that: settled. So, it is important to realize the extent of your injuries, how much it will cost and how long it will take to recover, etc. It is crucial to know, prior to settlement, what your treatment plan entails and any long-term ramifications of the initial accident, especially if you are facing some form of permanent disability. In that event, any settlement you agree to should take into account future expenses as well as lost income potential.

What do I pay in attorney's fees?

Our fee is charged only if there is a settlement or if a court determines compensation. There are no up front or out-of-pocket expenses. Taking your personal injury or medical malpractice case is the risk we take.
