Was Malpractice Involved?
Genetics (i.e. chromosomal disorders) may explain a child's condition, but often birth injuries are due to malpractice or medical error. Life-altering birth injur can occur when the doctor or nurse does not read or reads incorrectly fetal monitoring strips. Fetal distress (poor monitoring of fetal test strips) is not dealt with in a timely manner, resulting in poor blood supply.
Birth injury can result in Cerebral palsy, Brachial Plexus Palsy, or Erb's Palsy, usually permanently disabling.
How the Injury Occurs
The brain regulates and coordinates body activity and requires oxygen via respiration. Traumatic birth injury broadly describes anoxic and mechanical trauma to the brain (avoidable and unavoidable) of an infant during the labor and delivery process.
Anoxic trauma involves diminished supply of oxygen in the blood apart from normal ability of the infant to take in oxygen and may be due to reduced supply, obstructions of the respiratory tract, or insufficient respiratory movement. Cerebral palsy is a possible outcome.
Mechanical trauma involves physical damage, often to the skull, that inhibits oxygen from getting to the brain.
